Welcome to scalingdeals.com (the “Website”), run by Scaling Deals (“Scaling Deals,” “we,” or “us”). These Terms of Service (the “Terms”) cover your use of the Website and any content, forms and features on it. By using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Website.
Clients. If you sign up for our paid Services, your signed client agreement controls our work together, including fees, the lead guarantee, what counts as a lead, and ownership. If these Terms and your client agreement say different things, your client agreement wins.
1.Who can use the Website
You must be at least 18 years old (or the age of adulthood where you live, if higher) to use the Website. By using it, you confirm you meet this requirement.
2.Our Services, offers and guarantee
Scaling Deals builds and runs Google Ads for real estate investors and wholesalers. Offers on the Website, including our lead guarantee, are a summary only. The full details are in your client agreement.
- Lead guarantee. Our guarantee (for example, 50 exclusive seller leads in 32 days) depends on the ad budget, target areas and other terms we agree on together before we start. If we don’t reach the guaranteed number, our remedy is the one written in your client agreement (for example, we keep working with no management fee until we reach it). The guarantee is about leads, not closed deals, income or profit.
- Ad spend. Ad spend is paid by you, directly to Google or through your own ad account. Ad costs change with your market and are not controlled by us.
- Payments. Setup fees and other charges are processed by Stripe and are covered by your client agreement.
3.What you own
If you become a client, the Google Ads account, tracking accounts, domain, and the website and pages built for you under your client agreement belong to you. Our tools, software, processes, templates, negative keyword lists, automations, AI systems and know-how stay ours. Hosting, AI calling, skip tracing and other ongoing services end when our work together ends, as explained in your client agreement.
4.Our content
Everything on the Website, including text, graphics, logos, images, videos, and the Scaling Deals name and brand, belongs to Scaling Deals or the people who licensed it to us, and is protected by law. You may not copy, share, change or reuse it without our written permission.
5.Using the Website the right way
You agree to use the Website only for lawful purposes. You may not:
- Break any law while using the Website;
- Try to get into parts of the Website or our systems you are not allowed to access;
- Upload viruses or harmful code;
- Pretend to be someone else, or submit false information in our forms;
- Use bots, scrapers or other automated tools to collect content from the Website without our written permission.
We may block your access if you break these Terms.
6.Calls, texts and recordings
When you submit a form or book a call, you agree to be contacted by calls, texts and emails, including automated or AI calls and texts, as described in our Privacy Policy. Reply STOP to any text to opt out. Calls with our team may be recorded for quality and training; by booking and attending a call, you agree to the recording.
7.Other websites and tools
The Website may link to or use other companies’ websites and tools (for example, Stripe, Google, Meta, Wistia and our scheduling tool). They have their own terms and privacy policies. We are not responsible for their content, practices or uptime.
8.No professional advice. Results vary.
Content on the Website is for general information only. We do not give legal, tax, accounting, financial or real estate advice. Results shown on the Website are not typical and depend on your market, budget, team, follow-up, sales process and other things outside our control. We do not promise any income, number of deals or profit. Talk to qualified professionals about your situation.
9.Testimonials and client results
Testimonials on the Website are from real clients. By working with us, you allow Scaling Deals to use your name, business name, likeness, testimonial and results in our marketing, including case studies, ads and social media, as allowed by your client agreement. All testimonials must be true. If you don’t want to be featured, email support@scalingdeals.com and we will work it out with you.
10.Copyright complaints (DMCA)
If you believe something on the Website breaks your copyright, send a notice to support@scalingdeals.com or mail it to Scaling Deals, 30 N Gould St, Ste R, Sheridan, WY 82801, USA. Include: (a) the copyrighted work; (b) the material you believe is infringing and where it is; (c) your contact information; (d) a statement that you believe in good faith the use is not allowed; and (e) a statement, under penalty of perjury, that you are allowed to act for the copyright owner.
11.No warranties
THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THE WEBSITE WILL ALWAYS BE AVAILABLE, ERROR-FREE OR SECURE.
12.Limit of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, SCALING DEALS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES FROM YOUR USE OF THE WEBSITE, INCLUDING LOST PROFITS, DATA, BUSINESS OR GOODWILL. OUR TOTAL LIABILITY FOR YOUR USE OF THE WEBSITE WILL NOT BE MORE THAN ONE HUNDRED U.S. DOLLARS ($100). FOR CLIENTS, THE LIMIT OF LIABILITY IN THE CLIENT AGREEMENT APPLIES INSTEAD.
13.Governing law and courts
These Terms and any dispute about the Website are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute must be brought only in the state or federal courts located in Sheridan County, Wyoming, and you agree to those courts’ jurisdiction. For clients, the dispute terms in the client agreement apply instead.
14.Time limit for claims
Any claim about the Website must be brought within one (1) year after it first arises, or it is waived, to the fullest extent allowed by law.
15.Events outside our control
We are not responsible for delays or problems caused by events outside our reasonable control, such as natural disasters, cyberattacks, government action, internet outages, or outages or policy changes at Google, Meta or other platforms.
16.Other terms
Severability. If any part of these Terms is found unenforceable, it will be changed only as much as needed to make it enforceable, and the rest stays in effect.
No waiver. If we don’t enforce a part of these Terms, we can still enforce it later.
Changes. We may update these Terms from time to time. We will post the new version here and change the “Last updated” date. Using the Website after a change means you accept it.
